We exclusively work according to the German Forwarders Standard Terms and Conditions (ADSp), latest version.
In paragraph 23 ADSp these are limiting the legal liability for the damage of goods according to § 431 HGB for damages in the safe keeping of forwarders to 5 EUR/kg. For multimodal transports including transports by ship to 2 Special Drawing Rights (SDR)/kg as well as over and above per loss or lossevent to 1 Mio EUR or 2 Mio EUR respectively or 2 SDR/kg, depending on which amount higher. The liability of the air freight forwarder is based upon the Convention for the Unification of Certain Rules for International Carriage. In respect of Article 22 in the carriage of cargo, the liability of the carrier in the case of destruction, loss, damage or delay is limited to a sum of 19 SDR per kilogram, regardless of paragraph 27 ADSp.
